COVID-19 : NOVEL CORONAVIRUS

Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand.

LEGISLATION CHANGES

National Health (Highly Specialised Drugs Program) Special Arrangement 2021 

  • Revokes and remakes the National Health (Highly specialised drugs program) Special Arrangement 2010.

National Health (Listing of Pharmaceutical Benefits) Amendment Instrument 2021 (No. 3) 

  • Among other things, changes the date of repeal of Section 10A(3) of the National Health (Listing of Pharmaceutical Benefits) Instrument 2012 from 1 April 2021 to 1 January 2022, to ensure that temporary measures for modified prescription circumstances during the COVID-19 pandemic remain in effect during the current health pandemic.


Magistrates Court (Public Health (COVID-19) Infringement Notices) Amendment Regulation 2021 (No 1) 

  • Amends the Magistrates Court (Public Health (COVID-19) Infringement Notices) Regulation 2020,  which currently expires on 3 April 2021, to remain temporary and to expire at the end of a 12-month period during which no COVID-19 public health emergency declaration has been in force.

Poisons and Therapeutic Goods Amendment (Restricted Substances) Regulation 2021 

  • Extends the operation of special provisions, which were enacted in response to the COVID-19 pandemic, for the prescription and supply of restricted substances.

Public Health Amendment (COVID-19 Mandatory Face Coverings) Regulation (No 2) 2021 

  • Allows for the issue of penalty notices for an offence against Section 10 of the Public Health Act 2010 involving a contravention of a Ministerial direction under the Public Health (COVID-19 Mandatory Face Coverings) Order (No 2) 2021 to wear a fitted face covering in certain circumstances inside NSW airports and on domestic commercial aircrafts.

Public Health (COVID-19 Northern Rivers) Order 2021 

  • Restricts gatherings in certain local government areas, prohibits certain music festivals, and requires persons in certain local government areas to wear a fitted face covering in particular circumstances.


Revocation of Declarations and Approval - COVID-19 Vaccine 

  • Revokes the declarations and approval made by the instrument entitled Declarations and Approval - COVID-19 Vaccine.


Restrictions for Queensland (No. 2) 

  • Restricts visitors to residential premises, restricts indoor and outdoor gatherings, restricts certain businesses, activities and undertakings, and requires face masks to be carried and worn in certain circumstances.


Approval of Extension of a Major Emergency Declaration Under Section 23 

  • Amends curfew and time restriction requirements in permits in force under the Land Use Planning and Approvals Act 1993.

Emergency Management (Cross Border Travel - General) (COVID-19) Direction 2021 

  • Establishes control measures and sets requirements, restrictions and prohibitions for people arriving in South Australia, or who have recently arrived in South Australia, appropriate to the level of risk associated with locations visited by those persons prior to arrival.


Direction Under Section 16 - (Management of premises - No. 11)

  • Sets capacity requirements for certain premises.

Direction Under Section 16 - (Mass gatherings - No. 3) 

  • Restricts mass gatherings at certain premises.

Notice Under Sections 11 and 17 of COVID-19 Disease Emergency (Miscellaneous Provisions) Act 2020 

  • Provides exemptions for certain document signature requirements.

Notice Under Sections 11, 18 and 19 of COVID-19 Disease Emergency (Miscellaneous Provisions) Act 2020 

  • Declares exemptions for certain local government council or planning authority meeting requirements, and for public exhibition of documents and information.

Notice Under Sections 14 of COVID-19 Disease Emergency (Miscellaneous Provisions) Act 2020 

  • Provides exemptions for certain document signature requirements.


Exemption of Persons From Clause 8 of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020 - Cook Islands (No 2) 

  • Exempts certain persons arriving from the Cook Islands from certain quarantine requirements under the COVID-19 Public Health Response (Air Border) Order (No 2) 2020.
